Right To Bear Arms: A Pen Is More Powerful Than A Bullet!

Updated: 3 days ago

Question: Who granted the police and other local authorities the right to bear arms to protect and serve the People?

Answer: The People created the Commonwealth of Pennsylvania and then created a state legislative, executive and judicial branch of government. The People granted certain powers to the government to handle the People’s business and to protect the People’s private rights (Declaration of Rights). And the People reserved their rights to everything else not specifically mentioned. (see evidence below)

All power is inherent in the people, and all free governments are founded on their authority and instituted for their peace, safety and happiness. For the advancement of these ends they have at all times an inalienable and indefeasible right to alter, reform or abolish their government in such manner as they may think proper. (Article I, Section II Pennsylvania Constitution)

To guard against the transgressions of the high powers which we have delegated, we declare that everything in this article is excepted out of the general powers of government and shall forever remain inviolate. (Article I Section XXV Pennsylvania Constitution)

So basically, the question asked above is “who’s your Daddy?” In a world with so much information at our disposal and living in a society with so many highly touted educational institutions, we may have “intentionally” been misdirected in our ability to learn the fundamental principles of law which keep our public servants in check. (see evidence below)

That a frequent recurrence to fundamental principles, and a firm adherence to justice, moderation, temperance, industry, and frugality are absolutely necessary to preserve the blessings of liberty, and keep a government free: The people ought therefore to pay particular attention to these points in the choice of officers and representatives, and have a right to exact a due and constant regard to them, from their legislatures and magistrates, in the making and executing such laws as are necessary for the good government of the state. (Article I Section XIV Pennsylvania Constitution)

I think we have just established that their is a distinct trust agreement between the government (trustee/servant) and the people (sovereign, grantor, beneficiary, trust protector) and the People’s right to bear arms unimpeded. Correct? (see evidence below)

Senators, Representatives and all judicial, State and county officers shall, before entering on the duties of their respective offices, take and subscribe the following oath or affirmation before a person authorized to administer oaths. "I do solemnly swear (or affirm) that I will support, obey and defend the Constitution of the United States and the Constitution of this Commonwealth and that I will discharge the duties of my office with fidelity." The oath or affirmation shall be administered to a member of the Senate or to a member of the House of Representatives in the hall of the House to which he shall have been elected. Any person refusing to take the oath or affirmation shall forfeit his office. (Article VI Section III Pennsylvania Constitution)

Folks! All your power and sovereignty is in your State Constitution’s (plural). Quit messing with the U.S. Constitution and 2nd Amendment stuff! The People created the States. The States granted only a few enumerated powers to the federal (Article I Section VIII U.S. Constitution). The hierarchy is plain as day! I’ve been hit in the head once, or a few hundred times, left dumb, but I’m not stupid! I’m also not an attorney, never aspired to become a member of the BAR, nor do I practice law. I’m only showing you that you need to study a little harder and stand on your God given rights! A lawyer doesn’t know the Constitutions (plural), nor will he take you into a lawful jurisdiction where you can stand on your rights! (Right to bear arms = law, carry permit = statute.  law > statute) So don't rely on them to show you the law. They don't teach this in law school! (case law = coleslaw)

Let it sink in! A carry permit (permission, privilege, benefit, government control, statute, administrative, expense) vs. right to bear arms (constitution, right, maxims of law, sovereignty, God fearing, judicial, freedom, inexpensive). Why use the amendment (2A) of a lesser document (U.S. Constitution) when you already have the "right to bear arms" in your State’s Constitutions?(ex. PA, GA, AZ, etc.) (see evidence below)

That the people have a right to bear arms for the defense of themselves and the state. (Article I Section XIII Pennsylvania Constitution)

Maxim of Law: 9a. The laws permit the taking up of arms against armed persons. 2 Inst. 574.

Maxim of Law: 9b. Under the name of arms are included, not only shields and swords and helmets, but also clubs and stones. Co. Li&. 162.

Maxim of Law: 9c. It is a liberty of free citizens to retain arms for their protection according to their condition. People v. Horton, 264 N.Y.S. 84, 88.

Maxim of Law: 9d. Laws are silent amidst arms. 4 Inst. 70.

We The People granted the powers and permission for our police and law enforcement to protect our private rights and to bear arms! Does this not grant us (as the grantor) the right to also bear arms for our own protection? Hmmm! (law of trusts)

Now that Chevron has been put to rest and the People have discovered the real law, the Supreme Court is speaking a language that tells us they know we know! And boy do we know! (get the book "Over Ruled" U.S. Supreme Court Neil Gorsuch) (see evidence below)

Please take Notice that the People are grateful that the Supreme Court has obeyed our lawful notice by declaring the original understanding of law as during the founding generation of this Nation, such as reaffirming that government has no sovereign immunity when the People’s rights are violated (Kirtz v. Dept of Ag), that non-judicial tribunals do not provide constitutional due process by the common law (SEC v.Jarkesy), that there is no immunity for unofficial acts of public officers (Trump v. United States), and that the American people are sovereign over government (Loper v. Raimondo).

Your pen game is more powerful than any bullet! You must declare your rights to stand on them (status, standing and jurisdiction). You must express them in writing to make them stick! We need to teach government the law. That is our responsibility! I have learned (credit Dave Jose) how to move government lawfully and peacefully, and how to teach and instruct our public servants of both the blue and red teams (who need to be reminded what they swore an oath to uphold!) and they can never rebut your claims! Just like the Constitution commands, a frequent recurrence to fundamental principles must be addressed.

If the Lord wills, On Monday, October 21, 2024 @ 7pm. I invite you all to a Zoom meeting workshop where we will peaceably assemble to construct a right to bear arms notice, directing the government with real law. This document (Pennsylvania Notice of the People’s Right to Keep and Bear Arms Without Permission) will be sent to a specific group of recipients, with a specific type of delivery, expressing our rights, and by this, creating the highest lawful arms carry permit document you could ever register! Best part! Even if you don't own arms it will protect your rights in other capacities just by placing the government on notice! (see evidence below)

Maxim of Law 9f. The People have a right to bear arms for the defense of themselves and the state.

God Bless!

One of the People! Joe Divosevic
